Rental, Indemnity, and Warranties
This agreement is a contract for the rental of the vehicle. We may repossess the vehicle at your expense and without notice if it is abandoned or used in violation of the law or this agreement.
You agree to indemnify, defend, and hold us harmless from all claims, liabilities, costs, and attorney’s fees arising from this rental and your use of the vehicle.
We make no warranties, express or implied, regarding the vehicle, including any warranty of merchantability or fitness for a particular purpose.
Condition and Return of Vehicle
You must return the vehicle to our rental office on the date and time specified in this agreement and in the same condition in which you received it, except for ordinary wear and tear.
If the vehicle is returned after business hours, you remain responsible for the vehicle’s safety and for any damage or loss until it is inspected during our next business day.
Any service, repair, or replacement of parts or accessories during the rental period must receive our prior approval. You are also responsible for checking and maintaining all fluid levels.
Responsibility for Damage or Loss; Reporting to Police
You are responsible for all loss, theft, or damage to the vehicle. This includes repair costs, the vehicle’s actual cash value if it is not repairable, loss of use, diminished value, and administrative expenses related to processing the claim.
You must report all accidents, theft, or vandalism incidents to both us and the police as soon as possible after discovery.
Breach of Agreement
The following actions are prohibited and constitute a breach of this agreement:
Allowing unauthorized or unlicensed drivers to operate the vehicle
Driving under the influence of drugs or alcohol
Providing false or misleading information to obtain or extend the rental
Using the vehicle for illegal purposes
Using the vehicle for towing, racing, or commercial transport without authorization
Transporting hazardous or illegal materials
Operating the vehicle outside approved geographic areas
Overloading the vehicle or driving on unpaved roads
Failing to properly secure cargo or use required child safety restraints
Tampering with the odometer
Continuing to operate the vehicle when fluid levels are low or damage is likely
Failing to report accidents involving injury or property damage to law enforcement
Transporting animals that cause damage to the vehicle
You waive all recourse against us for any criminal reports or prosecutions resulting from your breach of this agreement.
Insurance
You are responsible for all damage or loss caused to others. You agree to maintain auto liability, collision, and comprehensive insurance covering yourself, us, and the vehicle.
Where required by state law, or if you do not carry liability insurance, we may provide secondary liability coverage subject to the minimum legal requirements of the applicable state.
You and we reject Personal Injury Protection (PIP), medical payments, no-fault, and uninsured or underinsured motorist coverage where permitted by law.
Coverage may become void if you violate this agreement or fail to cooperate during a claim investigation.
Charges
You agree to pay all charges due under this agreement, including but not limited to:
Rental time and mileage charges
Additional driver fees
Optional products or services purchased
Fuel replacement charges
Applicable taxes and fees
Parking tickets, traffic violations, tolls, towing, impound, and storage fees
Vehicle recovery and repossession expenses
Collection costs and attorney’s fees
Late payment fees
Returned check fees
Cleaning fees for excessively dirty vehicles
Deposit
We may apply your deposit toward any amounts owed under this agreement.
Your Property
You release us, our agents, and employees from all claims related to loss or damage to personal property left in, on, or transported with the vehicle or stored at our offices, regardless of negligence.
Modifications
No term of this agreement may be waived or modified except through a written agreement signed by us.
To extend the rental period, you must return the vehicle for inspection and receive written approval for the updated return date.
This agreement represents the complete understanding between you and us regarding the rental. Any prior agreements or representations are void.
Miscellaneous
Our waiver of any breach of this agreement does not waive future breaches or your obligations under this agreement.
Acceptance of payment or failure to enforce any rights under this agreement does not constitute a waiver of those rights.
Unless prohibited by law, you release us from liability for consequential, special, or punitive damages related to the rental or reservation of a vehicle.
If any provision of this agreement is found unenforceable, the remaining provisions will remain valid and enforceable.
